INFORMATION COLLECTION & USE Registration and Orders
Generally, you
may use this website without providing any
personal information. However, to order HMR®
weight-loss foods, including participation in
HMR at Home®, or to request additional
information about HMR and its programs and
services, you will be asked to provide personal
information through a registration or other
"sign-in" process. In some cases, you will
create a permanent User ID through your email
address and a password. In all cases where you
wish to purchase weight-loss foods, you will
provide your name, shipping and billing address,
credit card information, phone number and email
address. We use this information for billing
purposes and to fill your orders. If we have
trouble processing an order, we will use this
information to contact you. We will also use
this information to contact you about related
items, or to provide additional information
about our products, programs and services,
including through our program newsletter and, if
you choose, through phone calls available to
weight-loss food purchasers. If you choose to
take advantage of our Request for Information
Form, we will send you specific information
about HMR and its products, programs and
services. In some cases, there may be follow-up
contact generated through our Request for
Information Form. In other cases, you may
voluntarily share personal information about
yourself and your weight-loss efforts and
experiences.
HMR is the sole owner of the
information collected on this website.
Uses of Information
We use the personal
information you provide to process and fill your
weight-loss foods and other product orders, keep
in communication with you regarding processing,
delivery and billing of all orders, including
taking additional orders and to provide
additional information regarding our products,
programs and services. We will also use this
information to identify purchasing trends,
traffic to our website, and sales and marketing
information. In some cases, we may speak to you
on the phone to provide weight-management
counseling when you join HMR at Home, or to
provide or share information when you complete
and forward an Request for Information Form.
To the extent that you provide us with
personal information from your weight-loss
experience as a member of HMR at Home or
otherwise as an Inquiry Contact party, we may
use such data for the purpose of evaluating and
further developing the HMR at Home Program and
similar self-directed weight-loss programs. We
may also use such data in aggregate form in
publications about HMR and to evaluate the
efficacy of our weight-loss programs and system.
Any use of such data will not include disclosure
of personally identifiable information about you
or anyone that provides such data about
themselves, and only non-identifying group or
aggregate information will be published or
otherwise disclosed.
In some cases,
persons in our programs have been asked or
volunteered to provide individual "testimonials"
about their experience. Testimonials typically
contain a great deal of personal information and
are only used when very specific consent is
given by the person providing the testimonial.
Information collected from you through this
website will never be used for this purpose
unless you and HMR agree, and you provide a
specific and clear consent to use and publish
the testimonial.
Communications from the
Site Newsletters
HMR will publish a
newsletter to provide information about our
programs, products and services and related
weight-loss information. Everyone who orders HMR
weight-loss foods will receive the newsletter.
We will use your name and email address to send
the newsletter to you. You may, however,
unsubscribe from the newsletter if you choose.
Please see the CHOICE/OPT-OUT section.
Service-Related Announcements
We will send
you strictly service-related announcements on
rare occasions when it is necessary to do so.
For instance, if our service is temporarily
suspended for maintenance, we might send you an
email, or if there is something you need to know
about your order.
There is no option to
opt-out of these communications, which are not
promotional in nature and are directly related
to orders or other requests from you.
Customer Service
Apart from subscribing to
our Request for Information Form, we will
communicate with you from time to time in
response to your inquiries, to provide the
services you request, and to manage your
account. We will communicate with you by email
or telephone, as we determine what best suits
the situation.
Request for Information
Form
If you choose to request information
from us using our Request for Information Form,
we will contact you by regular mail.
INFORMATION SHARING AND DISCLOSURE
We
share both personally identifiable information
and information that does not identify
individual users to third parties (referred to
as aggregate information). In all cases, such
sharing of personally identifiable information
is necessary to provide you with the opportunity
to place online orders of HMR weight-loss foods
and other HMR products, become a member of HMR
at Home through online registration and receive
information from HMR through submission and
completion of the Request for Information Form.
HMR may also use and publish aggregate data
relating to the weight-loss experience of HMR at
Home members or others sharing their weight-loss
experience with us and may use aggregate data to
evaluate purchasing trends and patterns and
better evaluate our business performance and
operations. We do not sell your information to
anyone.
Agents
We use one or more
outside shipping companies to deliver orders,
and one or more credit card processing companies
to bill you for goods and services. We may use
other agents for similar purposes, as needed,
from time to time. These companies do not
retain, share, store or use personally
identifiable information for any purposes in
connection with information you provide to this
website except to process, deliver, bill and
collect on the orders you place.
Service
Providers
We use a software consultant and a
website hosting company to help us operate this
website and deliver goods and services to you.
We may use other service providers for similar
purposes, as needed, from time to time. In
rendering these services, these service
providers will or may have access to some or all
personally identifiable information that you
provide through this website. These service
providers are prohibited from using your
personally identifiable information for any
other purpose.
Legal Disclaimer
We
reserve the right to disclose your personally
identifiable information as required by law and
when we believe that disclosure is necessary to
protect our rights and/or to comply with a
judicial proceeding, court order, or legal
process served on our website.
CHOICE/OPT-OUT
If you no longer wish to
receive our newsletter or any other promotional
communications we may send in the future, you
may opt-out of receiving such communications by
following the instructions included in each
newsletter or promotional communication. In
addition, you may opt-out of the newsletter by
following the instructions in the "My Account"
section of this website.
LOG FILES
As is true of most websites, we gather
certain information automatically and store it
in log files. This information includes, among
other things, internet protocol (IP) addresses.
We use this information, which does not
identify individual users, to analyze trends, to
administer the site, to track users’ movements
around the site and to gather demographic
information about our user base as a whole.
We do not link this automatically-collected
data to personally identifiable information.
COOKIES
A cookie is a small text
file that is stored on a user’s computer for
record-keeping purposes. We use cookies on this
website. We do, in a few cases, link the
information we store in cookies to personally
identifiable information you submit while on our
website.
We use both session ID cookies
and/or persistent cookies. A session ID cookie
expires when you close your browser. A
persistent cookie remains on your hard drive for
an extended period of time. You can remove
persistent cookies by following directions
provided in your Internet browser’s "help" file.
We use session cookies for every visitor
to the website. These cookies never store any
personal information and track a randomly
generated session ID number that follows your
use during an individual visit to the website.
We will also use a session cookie for any
weight-loss food purchasers who link to this
website from HMR’s corporate website so that we
can better analyze information about such
linking users and their purchases.
If
you purchase weight-loss foods, or request
information through our Request for Information
Form, we set a persistent cookie to store your
personally identifiable information, User ID and
password so you do not have to enter it more
than once. Persistent cookies also enable us to
track and target the interests of our users to
enhance the experience on our website.
If you reject cookies, you may still use our
website, but your ability to use some areas of
our website may be limited or unavailable.

your personally identifiable information
changes, you may correct or update it by
following the instructions on the "My Account"

with any changes.
SECURITY
The
security of your personal information is
important to us. When you enter certain personal
information (such as credit card number) on our

another company, or sale of all or a portion of
its assets, your personally identifiable
information will likely be among the assets
transferred. You will be notified via notice on
our website for 30 days of any such change in
ownership or control of your personal
information.
CHANGES IN THIS PRIVACY
STATEMENT
If we decide to change our
Privacy Policy, we will post those changes to
this privacy statement so that you are aware of
what information we collect, how we use it, and
under what circumstances, if any, we disclose
it.
We reserve the right to modify this
privacy statement at any time, so please review
it from time to time.
